Where this data comes from

County-to-district assignments are transcribed from 28 U.S.C. §§81–131 as published by the Legal Information Institute, the statute that draws the districts. All 23 multi-district states reconcile to their full county counts.
Every one of the 93 court websites was fetched on 2026-09-04. Two courts publish their bankruptcy sites under the district court’s domain (Western District of Missouri, Southern District of Texas) and are listed at that address.
Divisional office cities come from each court’s own locations page. Some are hearing-only; the court says which.
Fees come from the U.S. Courts fee schedule and 28 U.S.C. §1930, held in one place in the code with a verification date so they cannot drift between the tool and the text.
State bar referral links were fetched too. Where a bar runs no referral service or its page could not be verified, the tool says so and shows the ABA directory instead of guessing.

Which bankruptcy court do I file in?

The one for the federal judicial district where the filer has lived for the greater part of the 180 days before filing (28 U.S.C. §1408). Bankruptcy courts are units of the federal district courts, so the map is the federal district map: 26 states, the District of Columbia, Puerto Rico and the territories are each a single district, and 23 states are divided into two, three or four districts county by county under 28 U.S.C. §§81–131. Arkansas is the odd case — two districts, one bankruptcy court that serves both. Within a district, cases are assigned to a divisional office, often by county as well; the court’s own site publishes that second map and says which offices are staffed. What does it cost to file?

The court’s fee is national and fixed. It is the sum of a statutory filing fee set by Congress in 28 U.S.C. §1930(a) and add-ons set by the Judicial Conference in the Bankruptcy Court Miscellaneous Fee Schedule (effective 2023-12-01):

Under 28 U.S.C. §1930(a) and Fed. R. Bankr. P. 1006(b), an individual may apply (Official Form 103A) to pay the filing fee in up to four installments, all within 120 days of filing; for cause the court may extend the last payment to 180 days. Until the fee is paid in full, no further payment may be made to an attorney or petition preparer for the case. Under 28 U.S.C. §1930(f) and Rule 1006(c), a Chapter 7 filer may apply (Official Form 103B) to have the fee waived if household income is below 150% of the federal poverty line for the household size and the filer cannot pay in installments. There is no fee waiver for Chapter 13; the fee is typically paid through the plan or in installments. How do I find a bankruptcy attorney in my district?

Start with routes that are not advertising. The state bar’s lawyer referral service (linked in the tool where we could verify it; the ABA keeps a directory) typically offers a short consultation for a small fixed fee. The NACBA directory lists consumer bankruptcy attorneys by state. For income-qualified households, LSC-funded legal aid handles bankruptcy in many areas, and most courts list pro bono clinics on their own sites. Then vet: whether the lawyer practices in this district regularly, what the flat fee covers, how Chapter 13 fees are paid through the plan, and who attends the 341 meeting. Can I file in a different state?

Only where 28 U.S.C. §1408 puts venue. A case may be commenced in the district where the filer’s domicile, residence, principal place of business or principal assets have been for the 180 days immediately before filing — or, for someone who moved during that window, the district where they were located for the longer portion of it. In practice, a person who moved two months ago generally still files in the old district; a person who moved four months ago files in the new one. Venue is not the same question as which state’s exemption law applies: 11 U.S.C. §522(b)(3) uses a 730-day look-back for that, so recent movers can find themselves filing in one state under another state’s exemptions. Both questions are routine for a local attorney and worth asking in the first consultation.

Which bankruptcy court do I file in?

Bankruptcy cases are filed in the United States Bankruptcy Court for the federal judicial district covering where the filer has lived for the greater part of the 180 days before filing (28 U.S.C. §1408). Twenty-six states, DC, Puerto Rico and the territories have one district, so the state alone answers the question; Arkansas has two districts but one bankruptcy court serving both; and twenty-three states are split into two to four districts by county under 28 U.S.C. §§81–131, which is what the finder above looks up.

Is there a bankruptcy court in my county?

Usually not in the county itself. Each district has one or a handful of divisional offices in larger cities, and many of those are hearing-only locations rather than staffed clerk’s offices. Filers in most of the country either file electronically through an attorney, mail the petition to the district’s main clerk’s office, or travel to it. The court’s own locations page, linked from the result above, says which offices accept filings.

How much does it cost to file bankruptcy?

The court fee is $338 for Chapter 7 (a $245 statutory filing fee under 28 U.S.C. §1930(a), a $78 administrative fee, and a $15 trustee surcharge) and $313 for Chapter 13 ($235 plus the $78 administrative fee), per the U.S. Courts Bankruptcy Court Miscellaneous Fee Schedule in force since 2023-12-01, verified 2026-09-04. The fee is the same in every district. Attorney fees, the required credit-counseling and debtor-education courses, and any petition-preparer charge are separate.

Can the bankruptcy filing fee be waived or paid over time?

Both are possible. Any individual may apply on Official Form 103A to pay the fee in up to four installments within 120 days of filing, extendable for cause to 180 days (28 U.S.C. §1930(a); Fed. R. Bankr. P. 1006(b)). A Chapter 7 filer whose household income is below 150% of the federal poverty line and who cannot pay in installments may apply on Form 103B to have the fee waived entirely (28 U.S.C. §1930(f); Rule 1006(c)). There is no waiver for Chapter 13. Until the fee is paid in full, no further payment may be made to an attorney or petition preparer for the case.

The routes that do not depend on advertising are the state bar’s lawyer referral service (linked per state above where we could verify the page; the American Bar Association keeps a directory of them), the National Association of Consumer Bankruptcy Attorneys member directory, and, for income-qualified households, LSC-funded legal aid through the LSC locator. Many bankruptcy courts also list pro bono and self-help resources on their own sites. Can I file bankruptcy in a different state than where I live?

Only in the narrow situations 28 U.S.C. §1408 allows. Venue is proper in the district where the filer’s domicile, residence, principal place of business or principal assets have been located for the 180 days before filing, or for the greater part of that period if they moved. Someone who relocated two months ago generally still files where they came from; once more than half of the 180-day window (about 91 days) has been spent in the new district, venue shifts there. Exemption rules follow a separate, longer test in 11 U.S.C. §522(b)(3) (730 days), so moving can change which state’s exemptions apply even after venue has moved.
